Statutory Sliding Scale for Estate Administration
Under Fla. Stat. § 733.617, personal representative ordinary compensation is presumed reasonable based on the estate probate inventory value and income earned during administration:
- 3.0% on the first $1,000,000
- 2.5% on all amounts between $1,000,000 and $5,000,000
- 2.0% on all amounts between $5,000,000 and $10,000,000
- 1.5% on all amounts exceeding $10,000,000
Important Homestead Note: Under Florida law, protected homestead real property that descends to heirs is NOT a probate asset and cannot be included in the fee base for personal representative statutory commissions.
Excludes protected Florida homestead real estate.
